The judgment comes after the court heard extensive arguments from all parties involved in the long-standing dispute. The petitioners' counsel informed the court that a previously formed committee had recommended either the removal of encroachments from these plots or a refund of payments to the original allottees. During the proceedings, the Karachi Metropolitan Corporation (KMC) lawyer stated that multiple operations had been carried out to clear the encroachments. However, the current occupants assert their possession based on leases issued by the Board of Revenue. The KMC's legal representative also highlighted an ongoing ownership dispute between the KMC and the Board of Revenue regarding the land, noting that related civil cases are still pending in various courts. A government lawyer explained that the Board of Revenue initially leased the land to KMC for a 30-year term in 1963, which expired in 1993. Following the lease's expiration, the land was subsequently allotted for residential purposes by the administrator. The petitioners contended that despite making payments, they have been denied possession of their plots for three decades. They accused both institutions of providing misleading information. Advocate Usman Farooq, representing the petitioners, emphasized that the affected parties have faced significant hardship since 1993. He clarified that while KMC had allocated these plots for cottage industries in Landhi, the allottees have not gained possession of the land since 1993.
