Khalid's arrest followed the Delhi riots, where he was accused of involvement. However, a significant point of contention is the continued freedom of leaders from the ruling BJP who were alleged to have made inflammatory speeches during the same period. Khalid, on the other hand, remains held under a contentious Indian act that allows for detention without trial and denies the right to bail, effectively bypassing standard legal procedures.
The human toll of this protracted legal limbo is severe. The Indian magazine The Quint reports that Khalid is suffering from profound mental distress, experiencing feelings of suffocation and breathlessness due to his extended confinement. His mother continues to grieve, her eyes often tearful from the pain of separation. His father has openly declared the Indian justice system "completely dysfunctional," expressing a profound lack of confidence in its processes.
The case has attracted external attention, with Zahran Mamdani, a New York-based public figure, sending a letter of solidarity to Khalid. Domestically, even former Indian Justice Deepak Gupta has voiced strong disapproval, criticizing the Supreme Court. Gupta argued that the court's delays in processing the case have stripped Umar Khalid of his fundamental rights to freedom and a swift, fair trial. Khalid's six-year detention without a verdict continues to cast a long shadow over the principles of justice and due process in India.
