This remand is connected to a case concerning alleged anti-state material. Iqrar-ul-Hassan's legal representative, Mian Ali Ashfaq, brought the matter before the Session Court, contesting the Magistrate's decision to grant physical custody. The defence's petition argues that the Magistrate's ruling lacked the necessary "solid and exceptional reasons" typically required for approving physical remand, emphasizing that such a measure should only be employed in extraordinary circumstances. Mian Ali Ashfaq highlighted that the National Cyber Crime Investigation Agency (NCCIA) already possesses four mobile phones and a tablet belonging to Iqrar-ul-Hassan. He contended that since these devices are already in the investigative agency's custody, the physical presence of the accused is not essential for their forensic analysis. The lawyer further argued that the forensic examination of the mobile phones and the process of gathering information from social media companies can proceed unimpeded without holding Iqrar-ul-Hassan in physical custody. He stressed that his client's physical remand is not a prerequisite for these ongoing investigations. The defence team has appealed to the court to revoke the order for Iqrar-ul-Hassan's physical remand and instruct the NCCIA to complete its inquiry without demanding his physical custody. Mian Ali Ashfaq also asserted that subjecting a journalist to physical remand based on social media posts undermines the fundamental principle of freedom of expression. Following the submission, the court has issued a notice to the investigating officer, requiring their presence at the subsequent hearing to address the matter.
