ENGLISH TITLE: Supreme Court Mandates Hearings Before Altering Employee Seniority
URDU TITLE:
ENGLISH ARTICLE:
In a pivotal ruling, the Supreme Court of Pakistan has declared that all employees must be granted a fair hearing opportunity before any changes are made to their seniority status. This requirement holds true even if their initial seniority was established contrary to existing rules.
The apex court underscored that seniority is a fundamental and valuable right for any employee, directly influencing their career trajectory and potential for advancement. However, the court also clarified that seniority itself does not guarantee automatic promotion; rather, promotions must be determined strictly in accordance with relevant laws and regulations.
The written judgment explicitly stated that it is essential to hear an employee's perspective before making any decision that could adversely affect their seniority. The Supreme Court highlighted a specific instance concerning Sindh Police personnel, whose seniority list was altered without providing them an opportunity to be heard. This action was deemed by the court to be in violation of Article 10A of the Constitution and the fundamental principles of justice.
The court noted that a crucial aspect—the lack of a hearing opportunity—had been overlooked by a previous bench, prompting a fresh review of the petitions. Consequently, the Supreme Court accepted these review petitions and retracted its earlier order issued on April 4, 2024. The appeals filed by the Sindh Police personnel were partially upheld, and the decision made by the Service Tribunal was nullified to the extent of the relevant petitioners.
The Supreme Court has now directed the concerned department to ensure that all petitioners and other affected individuals are provided a proper hearing. Following these hearings, the department is mandated to issue a comprehensive, reasoned decision. If the objections raised are found to be valid and any seniority changes are determined to be unlawful, a new seniority list must be compiled and published within two months of receiving the court's decision. Until a new decision is reached, the seniority list from November 18, 2020, will remain in effect for the concerned petitioners.
The landmark written decision was authored by Justice Muhammad Ali Mazhar, with Justice Musarrat Hilali and Justice Shahid Bilal Hassan also serving on the bench.
